'Dance Moms' news: prosecutor wants Abby Lee Miller behind bars

"Dance Moms" star Abby Lee Miller could be facing two-and-a-half years in prison after being indicted on 20 counts of fraud and a violation of currency reporting laws.

During the first part of Miller's sentencing, Assistant U.S. Attorney Greg Melucci urged Chief Judge Joy Flowers Conti to have the "Dance Moms" host sent behind bars.

Melucci argues that Miller deliberately tried to get out of paying hundreds of thousands of dollars in debt by hiding her $775,000 in income from a bankruptcy court.

However, it looks like it will be quite the challenge to convince Conti to have Miller do prison time because, as per CBS News, the federal judge has already filed tentative findings in which she appears to agree with Miller's attorneys' argument.

The defense argued that the "Dance Moms" star should only be up for probation since the creditors suffered no money loss out of the bankruptcy fraud.

Melucci, however, believes that Conti has the power to sentence Miller to prison on the basis of the amount of debt she did not wish to repay. "No one would rob a bank if he knew it had no money in it," Melucci said as per CBS News.

The second part of the sentencing is scheduled Feb. 24. This is where Miller's defense team will contend probation for the "Dance Moms" star, who is thankful for the support fans have been giving her.

"Throughout this case, Ms. Miller has taken both the allegations and the proceedings very seriously," Miller's attorney, Robert Ridge, previously told People in a statement.

"This has been a challenging time for Ms. Miller. She appreciates the words of encouragement and support from around the world," he went on to say.

Conti is expected to make a decision during the second hearing, if no after. That being said, it won't be long before the "Dance Moms" host learns whether she will have to do some time.
